1. What categories of data does the product or service collect from me?

  • Agronomic Data

  • Land Data

  • Farm Management Data

  • Machine Data

Compass Grower collects any or all of these at the choice of the customer:

Agronomic Data. This may include crop and field information such as planting data, seed type, yield, disease and pest management application, fertilization, and prescriptions.

Land Data. This may include soil data, geospatial information, field boundaries and descriptors.

Machine Data. This may include information added from third party providers including telematic data, machine health, fuel consumption and expenses.

Farm Management Data. This may include information related to financials, commodity prices, regulatory compliance, supply chain, and other contract management data. 

Compass Grower’s characterization of what data we collect from the producer is defined as in Schedule A, “Data Ownership”.

2. Do the ATP’s agreements address ownership of my data after my data is transferred?

As explained in Schedule A, Section 4 – “Data Ownership”, Compass Grower believes you the Client are the sole owner of all Data and have the right to transfer, share, upload, download, or delete that Data from the system at any time.

This does not apply to Non-Identifiable Data, which we may use for any lawful business purpose.

3. If the ATP contracts with other companies to provide data related services, does the ATP require these companies to adhere to the ATP’s privacy policies with me?

As explained in Schedule A “Privacy”, the Service Provider collects, stores, and uses Data collected from the Client in accordance with the Privacy Policy. Any disclosure of Data to a third party or partnering company as a result of integrations, mergers, or acquisitions will require the third party to process the Data as set forth in the Privacy Policy.

4. Will the ATP obtain my consent before providing other companies with access to my data?

As explained in Schedule B “Non-Identifiable Data”, by accepting the agreement you are giving consent for the Service Provider to use and share any Non-Identifiable Data with third parties.

However, as outlined in “Disclosure of Your Personal Information”, we may only share your Data, which does contain Personal Information, when we or our partners and affiliates, have your consent.

You may opt out of sharing Data that contains your personal information by providing written notice. 

In the event of a business transfer, your Data, including personal information, may be among the assets that is transferred.

5. After I upload data to the ATP, will it be possible to retrieve my original complete dataset in an original or equivalent format?

As explained in Schedule A “Data Ownership”, the client may export their Data at any time while using the Software, as well as export any remaining Data at time of termination.

6. Will the ATP notify me when its agreements change?

As explained in Schedule B, “Privacy Policy effective data and Notice of Changes”,we will post a notice of modifications to the Privacy Policy and will notify you through your account and by email.

7. Will the ATP notify me if a breach of data security occurs that causes disclosure of my data to an outside party?

As outlined in Schedule B – Protection of Personal Information, in the event of a data breach, natural disaster, or other unforeseen event that causes your Data to be deleted or compromised, we will notify you by email or as required by law.

8. Upon my request, can my original dataset be deleted when my contract with the ATP terminates?

The client may export their Data at any time while using the Software, as well as export any remaining Data at time of termination. As explained in Schedule A “Data Ownership” the provider may remove or destroy all Data stored on the Software ninety (90) days after the termination of the agreement.

Any Non-Identifiable Data (Non-Personal Information) that has been aggregated or disclosed may not be deleted at the expiry or termination of the Agreement.

9. Do the ATP’s agreements establish how long my original datasets will be retained?

As explained in Schedule A “Data Ownership” the provider may remove or destroy all Data stored on the Software ninety (90) days after the termination of the agreement.

10.  Do the ATP's agreements address what happens to my data if the ATP is sold to another company?  

As explained in Schedule B “Business Transfers” the client’s information may be among assets transferred during a merger or acquisition. However, any acquirer of these assets must continue to process your information as set forth in this Privacy Policy.
