1. What categories of data does the product or service collect from me?

As noted in Sections 5 and 6 of the User Agreement for Answer Tech and Data Silo (the “User Agreement”), WFU makes various apps available to retailers and their growers in Answer Tech. If an app is integrated with Data Silo, retailers and their growers will have the option to either permit or prohibit the app from sharing data with Data Silo. If permitted, the data collected by Data Silo may include personally identifiable information (e.g., first and last name, physical address, and email address), farm management data, weather data, machine data, land data (e.g., conservation data, tillage practice data, water management data, soil and fertility data, nutrient management data, environmental and ecological data, watershed data, topological data, elevation data and derivatives, drainage data, geospatial information system (GIS), global positioning system (GPS) and field boundary data, unmanned aerial system (UAS) data, sensor collection system (EC/EM) data, remote sensing including radar, spectral, and LIDAR data); and agronomic data (e.g., crop seed data, genetics data, planting data, prescription data, yield data, attribute data, quality data, disease and pest management data, crop protection data, crop protection use and application rates data, crop nutrition data, application and use of biological fertilizer data, application and use of  crop protection fertilizer data).

2. Do the ATP’s agreements address ownership of my data after my data is transferred?

Retailers and their growers are the owners of all data shared with Data Silo. In Section 6 of the User Agreement, retailers and their growers grant WFU a limited license to access and use their data for (i) populating, testing, developing, modifying and improving apps; (ii) informing retailers and their grower’s agronomic and other business decisions; (iii) performing support and other services for retailers or their grower’s benefit; and (iv) legal and regulatory compliance. In Section 6, Retailers and their growers also agree that WFU may aggregate their data in anonymized form, and that WFU owns such anonymized aggregations of data.

3. If the ATP contracts with other companies to provide data related services, does the ATP require these companies to adhere to the ATP’s privacy policies with me?

WFU may engage third party service providers to enhance, support, and host Data Silo. As part of such an engagement, third party service providers may have a need to access the data of retailers and their growers. In Section 6(d) of the User Agreement, WFU agrees to share data with third party service providers only to the extent necessary for them to perform their obligations. Section 6(d) also notes that all such third party service providers are subject to confidentiality and privacy obligations no less restrictive than those set forth in the User Agreement.

4. Will the ATP obtain my consent before providing other companies with access to my data?

In Section 6(d) of the User Agreement, retailers and their growers expressly authorize third party service providers access to data for limited purposes. If WFU offers additional integrations that facilitate data sharing with third party platforms or companies, WFU will obtain retailers’ consent prior to sharing any data via the integrations.

5. After I upload data to the ATP, will it be possible to retrieve my original complete dataset in an original or equivalent format?

Section 6 of the User Agreement states that upon request, WFU will make the retailers’ and their growers’ data available for retrieval in original or equivalent format.

6. Will the ATP notify me when its agreements change?

Section 12(g) of the User Agreement states that WFU will provide users with notice of any material revisions or updates within Answer Tech or Data Silo. Revisions and updates are effective when posted within Answer Tech or Data Silo.  Your continued use of the tools means you accept the revisions and updates to the agreement.

7. Will the ATP notify me if a breach of data security occurs that causes disclosure of my data to an outside party?

In Section 7(b) of the User Agreement, WFU agrees to notify impacted retailers and growers when it becomes aware of any unauthorized use of a retailers’ or growers’ log-in credentials, passwords, or any other breach of security that causes disclosure of data to third parties.

8. Upon my request, can my original dataset be deleted when my contract with the ATP terminates?

Section 6 of the User Agreement states that upon your request, WFU will remove your data from Data Silo within a reasonable period of time; provided, however, that WFU is not obligated to remove Aggregated Data or any Customer Data needed for recordkeeping or other legal purposes.

9. Do the ATP’s agreements establish how long my original datasets will be retained?

Section 6 of the User Agreement provides that unless you request that WFU remove our data from Data Silo, WFU may, but is not obligated to, retain your data in Data Silo indefinitely.

10. Do the ATP’s agreements address what happens to my data if the ATP is sold to another company?

The User Agreement does not address what happens to your data if the assets of Winfield Solutions, LLC are sold to another company.
