Product: The CattleOS Platform, including the web application, mobile applications (iOS and Android), APIs, and all associated services. This includes the GOLD Dashboard (Growth, Open rate, Length of calving, Death loss), herd management features, benchmarking analytics, and any integrated data tools provided through the Platform.

The categories of Ag Data collected are defined in Section 2.2 (Agricultural Data) of the CattleOS Privacy Policy and Ag Data Use Agreement. As a cattle management platform, our primary data category is Livestock Data, supplemented by Farm Management Data, and Climate/Weather Data as relevant to cattle operations.

3. Ownership: Do the tech company’s agreements address ownership of user data?

Section 3 (Ownership of Ag Data) of the CattleOS Privacy Policy and Ag Data Use Agreement explicitly states that CattleOS believes the user is the owner of Ag Data that originates from their farm, operation, device, or equipment. The Policy confirms that ownership gives the user the right to control, share, download, and delete their Ag Data at any time. CattleOS is granted only a limited license to use Ag Data for the purposes of providing the Platform services, and this license does not transfer ownership.

4. Transparency in Aggregation: Does the tech company allow the user to opt out of inclusion in anonymized and aggregated datasets that are accessible by other users?

Section 6 (Aggregated Data and Transparency) of the CattleOS Privacy Policy explicitly provides users with the right to opt out of inclusion in anonymized and aggregated datasets at any time through their account settings or by contacting support@cattleos.com. The Policy notes that aggregated datasets created prior to opting out cannot be retroactively modified, and that opting out may affect access to certain benchmarking features.

5. Vendor/Subcontract Access to Data: Does the tech company require outside contractors that have access to user data to follow the tech company’s data policies?

Section 7 (Data Sharing and Disclosure) of the CattleOS Privacy Policy states that all third-party contractors and subcontractors that have access to user data are required to follow CattleOS’s data policies, including the terms of the Policy, and are subject to confidentiality obligations. Third-party service providers may only access user data to the extent necessary to perform their services on behalf of CattleOS.

6. Consent to Share Data: Will the ATP obtain my consent before providing other companies with access to my data?

Section 7 (Data Sharing and Disclosure) of the CattleOS Privacy Policy states that CattleOS will obtain the user’s consent prior to sharing their Ag Data with any third party, including integrations, government agencies, and others. The Policy also states that CattleOS does not sell, rent, trade, or otherwise transfer personal information or Ag Data to third parties for their own commercial purposes. Users can share data with Trusted Advisors and Integrations only through their own explicit consent and direction.

7. Consent to Share Aggregated Data: By signing up, does the user give the tech company the right to sell aggregated data to third parties without obtaining further consent?

Section 6 (Aggregated Data and Transparency) of the CattleOS Privacy Policy explicitly states that CattleOS does not sell Aggregated Data to third parties. The Policy further states that by signing up for the Platform, the user does not give CattleOS the right to sell aggregated data to third parties without obtaining the user’s further consent. Aggregated Data is used only for internal research, product improvement, and benchmarking features within the Platform.

8. Portability: Does the tech company maintain an original copy of user data that can be retrieved or deleted upon a user’s request?

Section 8 (Data Portability) of the CattleOS Privacy Policy confirms that CattleOS maintains an original copy of user Ag Data and personal data that can be retrieved or deleted upon the user’s request. Users can download their Ag Data at any time while they maintain an active account. Users may also request their data in a commonly used, machine-readable format. Deletion is available at any time during an active account and for thirty (30) days after account termination. Section 11 (Your Privacy Rights) further confirms the Right to Erasure and Right to Data Portability.

9. Data Security: Will the tech company notify a user if a breach of data security occurs that causes disclosure of the user’s data to an outside party?

Section 9 (Data Storage and Security) of the CattleOS Privacy Policy includes a Breach Notification provision that states CattleOS will notify the user by email, by notification when they log in, or by other method required by law in the event of a data breach, natural disaster, or other unforeseen event that causes their Ag Data or personal information to be deleted or compromised. CattleOS will also notify applicable regulatory authorities in accordance with its legal obligations

10. Notice of Changes: Will the tech company notify a user when data agreements change and summarize how the agreements were changed?

Section 13 (Notice of Changes) of the CattleOS Privacy Policy states that CattleOS will notify users of any material changes to the Policy by: (1) posting the revised Policy on the Platform with an updated "Last Updated" date; (2) sending an email notification to the address associated with the user’s account; (3) displaying a prominent notice on the Platform at the user’s next login; and (4) providing a summary of the changes made to the Policy.

11. Do the tech company’s agreements address what happens to user data if the tech company is sold to another company?

Section 14 (Changes in Company Ownership) of the CattleOS Privacy Policy addresses what happens to user data in the event CattleOS is sold or acquired. The Policy states that if at least 51% of company ownership interest is transferred in a single calendar year, users will be notified and will have the option of downloading or deleting their Ag Data for at least thirty (30) days after the transfer. The Policy will continue to apply until the new owner provides notice of a new data use agreement, and the acquiring company must agree to honour the existing Policy with respect to the user’s Ag Data.
