Ambrook only offers one product under the Ambrook name. Ambrook’s product enables customers to discover and submit applications for agriculture-related financial assistance and a wallet feature and financial management tools that provide access and control of funds received through such assistance or through other means.

Who are the primary users of the product, platform, or services?

Farmers and ranchers seeking financial assistance or financial management tools to improve financial health and understanding of their operations.

In order to qualify and complete forms for funding programs, users may opt-in to submitting information requested by the USDA or other organizations hosting funding programs. This may include data related to yield/production records, business entities, conservation practices, location, and more. Additionally, users of our cashflow management suite can connect financial accounts to sync transaction data that generates feeds, reports, and useful insights, viewable only by the user. All of this information is editable or removable by the user within the app or by request through our support channels.

3. Ownership

Do the tech company’s agreements with the user address ownership of user data? 

Yes. Section 8 of the Ambrook Terms of Service provides that the user owns their “Materials”, which is defined to include their personal information and any content, materials, information, and data they provide including data provided in connection with their applications for assistance.

4. Transparency in Aggregation

Does the tech company allow the user to opt out of inclusion in anonymized and aggregated datasets that are accessible by other users? 

Not applicable. Ambrook does not make aggregated and anonymized datasets of user information accessible to other users, however, Ambrook may share these datasets with third parties.

5. Vendor Access to Data

Does the tech company require outside contractors that have access to user data to follow the tech company’s data policies?

6. Consent

Yes. All users must accept the Terms of Service and Privacy Policy when registered to use the Service or platform. This initial consent allows Ambrook the right to share user data with third parties as explained in Section 7 of the Terms of Service and the Section titled How Do We Share Personal Information in our Privacy Policy.

7. Consent

By signing up, does the user give the tech company the right to sell aggregated data to third parties without obtaining further consent?

Yes. This is expressly stated in Section 8 of the Terms of Service and in the Section entitled How Do We Share Your Personal Information in the Privacy Policy. However, the user can opt-out of having their personal information included in such aggregated or de-identified datasets.

8. Portability 

Does the tech company maintain an original copy of user data that can be retrieved or deleted upon a user’s request? 

Yes. Ambrook keeps a copy of the user’s personal information for as long as necessary to fulfill the purposes of using such information or for such period as may be required by applicable law, but may delete the information when it is no longer needed. Users can request access to such information and to delete such information, which requests will be managed in accordance with the Ambrook Privacy Policy and applicable legal requirements. This includes all materials submitted to the USDA or other organizations hosting funding programs.

9. Data Security

Will the tech company notify the user if a breach of data security causes disclosure of the user’s data to an outside party?  

Yes. Ambrook’s policy is to report any such data breaches that result in unauthorized disclosure as required by applicable law. This is confirmed in the Privacy Policy under the section entitled Information Security.

10. Notice

Will the tech company notify the user when data agreements are changed and summarize how the agreements were changed? 

Yes. The Terms of Service (Section 15) and Privacy Policy provide that any changes will be posted to the website. Ambrook anticipates that it will summarize any material changes when posted. Users that have an account will also be notified of such changes by email or when they need log into their account.

11. Changes in Company Ownership

Do the tech company’s data agreements address what happens to user data if the tech company is sold to another company?

Yes. The Privacy Policy provides that Ambrook can share the user data with any successor entity or acquirer. Ambrook would expect any such successor or acquirer would adhere to the privacy policy or provide notice of any changes in data collection practices.
