ESMC collects “Producer Information” which is defined in its General Terms and Conditions as follows: “Producer Information” means information, data, and other content, in any form or medium, that is uploaded, or otherwise received, directly or indirectly (including via a third-party provider), from Producer (including from a Permitted User on Producer’s behalf) by or through the ESMC Platform, or provided by Producer to ESMC hereunder.”

3. Ownership

Do the tech company’s agreements with the user address ownership of user data? 

Yes. ESMC’s General Terms and Conditions state “the Producer owns and will continue to own the Producer’s personal information and data regarding agricultural management practices entered into the Producer Portal.”

4. Transparency in Aggregation

Does the tech company allow the user to opt out of inclusion in anonymized and aggregated datasets that are accessible by other users? 

No. Opt out is not allowed. ESMC creates aggregated and anonymized datasets that data will be stored and utilized by ESMC to quantify, verify, and/or certify Credits generated as a result of operational activities; and that process will require that data and the Producer’s personal information be confidentially shared with ESMC modelers, technical contractors, verifiers, and other program staff and advisors to whom access is required or has otherwise been granted by the Producer.

5. Vendor Access to Data

Does the tech company require outside contractors that have access to user data to follow the tech company’s data policies? 

Yes. ESMC requires all its contractors, suppliers and vendors to execute confidentiality agreements for the purpose of maintaining the security and confidentiality of such information.

6. Consent

Does the tech company obtain a user’s consent before sharing user data with third parties? (E.g. integrations, government and others)

Yes. By signing a Producer Agreement, the Producer grants to ESMC a license to use, copy store, transmit, modify, and display the Producer Information in order to: (a) provide and administer the Program, including the generation of Credits; (b) for the further development of the Program, the ESMC Platform, and associated technologies, and (c) as expressly permitted in writing by Producer.

7. Consent

By signing up, does the user give the tech company the right to sell aggregated data to third parties without obtaining further consent?

Yes. ESMC’s Privacy Policy states: Aggregated, anonymized information including management practices and operational details may be collected, reported to, and used by ESMC and authorized third parties outside of the ESMC partner network.

8. Portability 

Does the tech company maintain an original copy of user data that can be retrieved or deleted upon a user’s request?
