AcreHedge, Inc.

What products, platform, or services within the tech company are certifying as Ag Data Transparent?

The services AcreHedge would like to certify include the online platform at acrehedge.com, https://app.acrehedge.com, its subdomains, and mobile web application.

Who are the primary users of the product, platform, or services?

AcreHedge provides tools for medium-to-large sized farmers (>500 acres) to centralize and organize their farming data in order to facilitate real-time visibility into crop performance and break-even analyses.


2. Categories of Ag Data Collected

What categories of data does the data platform collect?  

  • Agronomic Data.

  • Farm Management Data.

Section 4.1 of AcreHedge’s User Agreement provides that the platform collects "User Content," on Agronomic Data and Farm Management Data defined as materials provided such as information on crops, acreage, costs, expenses, and other financial or business details. AcreHedge also collects registration information and other details about the farmer and their farm operation necessary for account setup and service.

3. Ownership

Do the tech company’s agreements with the user address ownership of user data? 

Yes.

The agreement confirms User ownership of their “User Content” data, by stating that the Customer retains all rights to User Content.  Terms of Use Section 3.5 and 4.1

4. Transparency in Aggregation

Does the tech company allow the user to opt out of inclusion in anonymized and aggregated datasets that are accessible by other users? 

Yes. By agreeing to the terms, users grant AcreHedge a license to create and use such aggregated data for analytical purposes, service improvement, and other business purposes. Users have the option to opt out of having their data included in anonymized and aggregated datasets.

5. Vendor Access to Data

Does the tech company require outside contractors that have access to user data to follow the tech company’s data policies? 

Yes. The agreement requires contractors who access User Content to operate under confidentiality obligations specifically for the purpose of providing the Services and must adhere to the full scope of AcreHedge’s data policies. Terms of Use Section 4.4.

6. Consent

Does the tech company obtain a user’s consent before sharing user data with third parties? (E.g. integrations, government and others)

Yes. Consent for specific types of third-party data sharing is obtained when the user agrees to the Terms of Use. The agreement outlines specific scenarios where personally identifiable information may be shared without additional consent, including with contractors for service provision, during a business sale or transfer, or for legal compliance and protection purposes. 7. Consent

By signing up, does the user give the tech company the right to sell aggregated data to third parties without obtaining further consent?

Yes. Upon signing up, the user grants AcreHedge a broad license to use aggregated and anonymized data derived from their User Content for various business purposes, including analytics, service improvement, and informing the development and sales of AcreHedge's other services or products. 8. Portability 

Does the tech company maintain an original copy of user data that can be retrieved or deleted upon a user’s request? 

Yes. User data can be retrieved and deleted upon user request under Account Settings or termination initiated by AcreHedge for breach.

9. Data Security

Will the tech company notify the user if a breach of data security causes disclosure of the user’s data to an outside party?  

Yes. AcreHedge will notify users of breaches as required by GDPR and CCPA law. See Terms of Use Section 4.1

10. Notice

Will the tech company notify the user when data agreements are changed and summarize how the agreements were changed? 

Yes. AcreHedge will notify users of changes to the data agreements via email and/or notices on the Site or Account, providing at least 14 days' notice for substantial changes affecting active subscriptions, including a link to the revised terms and a summary of the changes. 11. Changes in Company Ownership

Do the tech company’s data agreements address what happens to user data if the tech company is sold to another company?

Yes, the agreement states that in the event of a sale, merger, or transfer of substantially all assets, AcreHedge can assign the Agreement (including its data terms and obligations) to the new entity, which will then be bound by those terms. The terms also permit sharing personally identifiable information in connection with such a transaction, without explicitly requiring separate user notification specifically about the data transfer aspect beyond general agreement change notifications.
