365, Insights, Scheduling, AgSense and Variable Rate Irrigation collect User Data from connected devices and APIs to provide services to users, including monitor & control, irrigation recommendations, and anomaly detection. 

“User Data” shall mean data obtained directly or indirectly from or through User or Userer’s use of the Software that is identified as User's Data and is not data in any form provided by Valmont.

3. Ownership

Do the tech company’s agreements with the user address ownership of user data? 

No. Valmont does not address “ownership” of User Data.  Instead, Valmont addresses these issues by explaining the license rights of users and Valmont in Section 4 of Valmont’s Terms.

4. Transparency in Aggregation

Does the tech company allow the user to opt out of inclusion in anonymized and aggregated datasets that are accessible by other users? 

Not applicable. Valmont does not make anonymized and aggregated datasets available to other users.

5. Vendor Access to Data

Does the tech company require outside contractors that have access to user data to follow the tech company’s data policies? 

Yes. Under Section 7 of Valmont’s Privacy Policy, Valmont agrees it will not present any User Data to third parties unless such third party is bound by a duty of confidentiality.

6. Consent

Does the tech company obtain a user’s consent before sharing user data with third parties? (E.g. integrations, government and others)

Yes. Section 7 of Valmont’s Terms of Use requires a User to provide a “Data Transfer Authorization” to Valmont before Valmont will allow transfer of data to a Valmont Approved Third Party.

7. Consent

By signing up, does the user give the tech company the right to sell aggregated data to third parties without obtaining further consent?

No. Valmont does not sell aggregated data to third parties.

8. Portability 

Does the tech company maintain an original copy of user data that can be retrieved or deleted upon a user’s request? 

Yes. Under Section 11 of Valmont’s Privacy Policy, following a written request, Valmont will provide customers with their uploaded complete dataset.

9. Data Security

Will the tech company notify the user if a breach of data security causes disclosure of the user’s data to an outside party?  

Yes. Section 9 of Valmont's Privacy Policy states our policies regarding notification in the event of a security breach.

10. Notice

Will the tech company notify the user when data agreements are changed and summarize how the agreements were changed? 

Yes. All users must acknowledge the Terms of Service electronically before accessing the product platform for use. When a new agreement is implemented, the customer will be notified electronically upon log in to the platform. The customer will be prompted with the new agreement and must acknowledge the new agreement before proceeding.

11. Changes in Company Ownership

Do the tech company’s data agreements address what happens to user data if the tech company is sold to another company?

No. User data is an asset of Valmont Industries and is transferred in ownership to another company that would acquire the Valmont Industries entity.
